Judgment BSG Honorary Doctors

The BSG decided yesterday (04.06.19): "Doctors who work as fee doctors in a hospital are not to be regarded as self-employed in this activity."

“The decisive factor is whether those affected are bound by instructions or integrated into a work organization.[…] In an operation, for example, anesthesiologists – like the doctor in the lead case – are usually part of a team that works together under the leadership of a responsible personen must.[…] Added to this is the fact that fee-based doctors predominantly use the hospital's human and material resources in their work. The doctor here was no different than the doctors employed in the hospital, and was fully integrated into the operational process. Entrepreneurial decision-making leeway is regularly not given when working as a fee-based doctor in a hospital. The amount of the fee is just one of many indicators to be taken into account in the overall assessment and is not decisive in this case.”

The integration into the operational process, the degree of specialization and the independence from instructions can also affect the typification of our work processes.
