Precedent judgment of the Berlin Social Court on ALGII for the self-employed

"The following judgment is issued on behalf of the people: The defendant (the Jobcenter Berlin Friedrichshain-Kreuzberg) is sentenced, repealing the decision of November 6th, 2020 in the form of the objection decision of December 29th, 2020, the plaintiff (Dany Rau) in the period from October 1st. 2020 until March 31, 2021 to grant benefits without taking assets into account in accordance with Section 12 of the Second Book of the Code of Social Law”. (Social Court Berlin No. S 157 AS 538/21)

In October 2020, Dany submitted an application for "ALG II in the simplified application procedure for the self-employed", as intended by the federal government to "mitigate the effects of the corona pandemic" and is still up to December 31, 2022. This application was answered with a rejection letter from the Jobcenter Berlin. Even an intervention by the BMAS at the request of the isdv did not change anything here. In January 2021, Dany filed a lawsuit against the rejection notice with the Berlin Social Court.

On June 2nd, 2022 (!), the social court in Berlin passed a groundbreaking judgment and ordered the job center to pay Dany ALGII for the period applied for in accordance with his application.

The appeal period expired on Friday, July 22, 2022. The judgment is thus a precedent and a success for all self-employed people who were denied ALG II because they had built up reserves for their old-age provision. They now have the opportunity to contest the rejection notices with reference to this judgment and thus receive the benefits retrospectively.
