On Friday, March 17th, 2023, the Higher Administrative Court in Münster passed the final judgment on the repayment of the emergency aid in North Rhine-Westphalia.
The Higher Administrative Court ruled that the recovery of the Corona emergency aid from the self-employed in North Rhine-Westphalia was illegal. In the justification, the court makes it clear that the country has set certain conditions for the payment. “The country then had to adapt to these requirements also hold when it later settled and reclaimed it," said court spokeswoman Gudrun Dahme to the Tagesschau.
This ruling is great for those who had appealed against the recovery order. Everyone else can only hope that the country will follow the verdict and recalculate. The state of North Rhine-Westphalia does not yet see this as necessary.
